Terms and conditions of participation

By participating in the giveaway on the Instagram page or the giveaway on this website, the user accepts these terms and conditions:

1. The organizer of the competition is Martyna Jezewicz, Frohnhauser Straße, 45143 Essen
2. The campaign period will be specified in the respective post or here on the website.
3. Only one entry per person is possible.
4. Participating influencers commit to using Martyna Jezewicz's caption.
5. Eligible to participate are persons residing in Germany, Austria, or Switzerland who are at least 18 years old. Minors may only participate with written consent or when accompanied by a parent or legal guardian.
6. Employees of Martyna Jezewicz and their relatives are excluded from participation in the competition.
7. Those eligible to win are the persons who comply with the conditions listed in the image caption on the channel/website.
8. The winner will be randomly drawn from all participants, publicly announced, and notified via a comment under the respective giveaway Instagram post or via direct messages.
9. The winner must claim the prize within one week of receiving the notification by sending their postal address via private Instagram message to the official Mareikefox page. Otherwise, the prize claim is forfeited and Martyna Jezewicz will draw a new winner. The postal address is only required for sending the prize.
10. To verify the actual distribution of prize money, the winner's name will be published in pseudonymized form, or the name of the Instagram profile (e.g. in a separate post under "Lena S. from Munich" or @lenna.s.muenchen).
11. Among all participants, 88 winners will be drawn, who can win products worth up to 2000 euros.
12. The prize will be sent to the winner by post or email.
13. The winner bears the transport risk.
14. The prize is non-transferable, cannot be exchanged, and cannot be paid out in cash.
15. Martyna Jezewicz reserves the right to make changes to the prize. In this case, the winner will receive a suitable replacement prize.
16. Legal recourse is excluded.
17. Participation via sweepstakes clubs, automated services or other service providers is not permitted.
18. The data provided by participants will be processed for the duration of the promotion and deleted after its completion, unless statutory retention or limitation periods apply. 19. Martyna Jezewicz reserves the right to exclude participants from the competition at any time without giving reasons if manipulation is suspected. If this involves an already drawn winner, the prize can be revoked retroactively; a prize that has already been delivered can be reclaimed.
20. Should individual clauses be or become invalid, the validity of the remaining clauses shall remain unaffected. The contractual relationship between the participant and Martyna Jezewicz is governed by German law.
21. The company (Martyna Jezewicz) reserves the right to terminate the competition, in whole or in part, at any time, even without prior notice. This applies in particular if proper execution cannot be guaranteed for technical reasons (e.g., manipulation) or legal reasons (e.g., prohibition by Instagram).

This promotion is in no way affiliated with, sponsored by, endorsed by, or administered by Instagram. By participating in this contest, all participants release Instagram from any and all claims or liability arising from or related to this contest. Instagram is not available as a contact person for this contest.

*Privacy notice

We process personal data of participants in prize draws and competitions only in compliance with the relevant data protection regulations, insofar as the processing is necessary for the provision, execution and processing of the prize draw (Art. 6 para. 1 sentence 1 lit. b. GDPR), the participants have consented to the processing (Art. 6 para. 1 sentence 1 lit. a GDPR) or the processing serves our legitimate interests (e.g. in the security of the prize draw or in protecting our interests from misuse through possible recording of IP addresses when submitting prize draw entries).

The data of the participants will only be transmitted to other bodies if this is necessary for the execution of the competition (e.g. for the purpose of sending prizes) or if a participant has consented to the transmission.

As part of the competition, we inform participants which of their details are required for participation.

Participant data will be deleted as soon as the sweepstakes or competition has ended and the data is no longer needed to inform winners or for follow-up questions regarding the sweepstakes. Generally, participant data will be deleted no later than six months after the end of the sweepstakes. Winners' data may be retained for a longer period, for example, to answer questions about the prizes or to fulfill prize obligations; in this case, the retention period depends on the type of prize and, for example, can be up to three years for goods or services, in order to process warranty claims. Furthermore, participant data may be stored for a longer period, for example, in the form of reports about the sweepstakes in online and offline media.

If data collected as part of the competition is also used for other purposes, its processing and retention period are governed by the data protection information for this use (e.g. in the case of registration for the newsletter as part of a competition).

Insofar as we process your data or provide additional information on the processing of your data, we will provide a link to our privacy policy and refer to it.

Participants, as data subjects under the GDPR, have various rights, which arise in particular from Articles 15 to 18 and 21 of the GDPR:

Right to object: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) of the GDPR, including profiling based on those provisions. Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
Right of withdrawal for consents: You have the right to withdraw any consent you have given at any time.
Right to information: You have the right to request confirmation as to whether data concerning you is being processed, and to access this data as well as further information and a copy of the data in accordance with legal requirements.
Right to rectification: In accordance with legal requirements, you have the right to request the completion of your personal data or the correction of inaccurate personal data concerning you.
Right to erasure and restriction of processing: In accordance with legal requirements, you have the right to request that data concerning you be erased without undue delay, or alternatively, in accordance with legal requirements, to request a restriction of the processing of the data.
Right to data portability: You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format, or to request its transmission to another controller, in accordance with the legal requirements.
Right to lodge a complaint with a supervisory authority: You also have the right, in accordance with legal requirements, to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work or the place of the alleged infringement, if you believe that the processing of personal data relating to you infringes the GDPR.
