Terms and Conditions

 

By participating in the sweepstakes on the Instagram page, or the sweepstakes on this website, the user accepts these terms and conditions:

 

1. The organizer of the sweepstakes is Martyna Jezewicz, Robert-Bosch-Str.7, 42489 Wülfrath
2. The promotional period will be determined in the respective post or here on the website.
3. Only one entry per person is permitted.
4. Participating influencers commit to using Martyna Jezewicz's caption.
5. Eligible participants are persons with residence in Germany, Austria, Switzerland, who have reached the age of 18. Minors may only participate with written consent or accompanied by a legal guardian.
6. Employees of Martyna Jezewicz and their relatives are excluded from participating in the sweepstakes.
7. Eligible winners are those persons who comply with the conditions listed in the caption on the channel/website. 
8. The winner will be drawn randomly from all participants, announced publicly, and notified via a comment under the respective sweepstakes Instagram post or by direct message.
9. The winner must accept the prize within one week of receiving the notification by sending their postal address via private Instagram message to the official Mareikefox page. Otherwise, the claim to the prize will expire, and Martyna Jezewicz will re-draw the prize. The provision of the postal address is solely for the purpose of sending the prize.
10. To prove the actual distribution of the prize, the winner's name will be published in pseudonymized form, or the name of the Instagram profile (e.g., in a separate post under "Lena S. from Munich" or @lenna.s.muenchen).
11. Among all participants, 88 winners will be drawn, who can win products worth up to 2000 Euros.
12. The prize will be sent to the winner by post or email.
13. The winner bears the transport risk.
14. The prize is not transferable and cannot be exchanged or paid out in cash.
15. Martyna Jezewicz is entitled to make changes to the prize. In this case, the winner will receive an appropriate substitute prize.
16. Legal recourse is excluded.
17. Participation via sweepstakes clubs, automated services, or other service providers is not permitted.
18. The provided data of the participants will be processed for the duration of the promotion and deleted after final processing of the promotion, provided that no retention or limitation periods prevent this. 19. Martyna Jezewicz reserves the right to exclude participants from the sweepstakes at any time without giving reasons if there is suspicion of manipulation. If it concerns a winner who has already been drawn, the prize can be subsequently revoked; a prize that has already been delivered can be reclaimed.
20. Should individual clauses be or become ineffective, the effectiveness of the remaining clauses shall remain unaffected. German law applies to the user relationship between the participant and Martyna Jezewicz.
21. The company (Martyna Jezewicz) reserves the right to terminate the sweepstakes at any time, in whole or in part, even without observing deadlines. This applies in particular if due to technical (e.g., manipulation) or legal reasons (e.g., prohibition by Instagram) a proper implementation is not guaranteed.

THIS PROMOTION IS IN NO WAY AFFILIATED WITH INSTAGRAM AND IS IN NO WAY SPONSORED, SUPPORTED OR ORGANIZED BY INSTAGRAM. BY PARTICIPATING IN THIS CONTEST, ALL PARTICIPANTS RELEASE INSTAGRAM FROM ANY CLAIMS OR LIABILITY IN CONNECTION WITH THE CONTEST. INSTAGRAM IS NOT AVAILABLE AS A CONTACT PERSON FOR THE SWEEPSTAKES.

We process personal data of participants in sweepstakes and contests only in compliance with the relevant data protection provisions, to the extent that the processing is necessary for the provision, execution, and processing of the sweepstakes (Art. 6 para. 1 sentence 1 lit. b. GDPR), the participants have consented to the processing (Art. 6 para. 1 sentence 1 lit. a GDPR) or the processing serves our legitimate interests (e.g., in the security of the sweepstakes or in protecting our interests from abuse by possibly collecting IP addresses when submitting sweepstakes entries).

The participants' data will only be transmitted to other parties if this is necessary for the execution of the sweepstakes (e.g., for sending prizes) or if a participant has consented to the transmission.

We inform participants within the scope of the sweepstakes which of their details are required for participation.

Participants' data will be deleted as soon as the sweepstakes or contest is over and the data is no longer required to inform the winners or because inquiries about the sweepstakes can be expected. In principle, participants' data will be deleted no later than 6 months after the end of the sweepstakes. Winners' data may be retained longer, e.g., to answer questions about prizes or to fulfill prize services; in this case, the retention period depends on the type of prize and is, for example, up to three years for items or services, e.g., to be able to process warranty cases. Furthermore, participants' data may be stored longer, e.g., in the form of reporting on the sweepstakes in online and offline media.

If data was also collected for other purposes within the scope of the sweepstakes, its processing and the retention period are governed by the data protection notices for this use (e.g., in the case of subscribing to a newsletter within the scope of a sweepstakes).

Insofar as we otherwise process your data or provide additional information about the processing of your data, we provide a link to our privacy policy and refer to it.

Participants, as data subjects, have various rights under the GDPR, which arise in particular from Art. 15 to 18 and 21 GDPR:

    Right to object: You have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you which is based on Art. 6 para. 1 lit. e or f GDPR; this also applies to profiling based on these provisions. Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
Right to withdraw consent: You have the right to withdraw given consent at any time.
